What an employment lawyer can help with

  • Wrongful termination and unfair dismissal
  • Discrimination because of race, sex, age, disability, religion, pregnancy or other protected characteristics
  • Harassment, including sexual harassment
  • Unpaid wages and overtime, and holiday pay
  • Retaliation and whistleblowing
  • Severance and settlement agreements
  • Employment contracts and non-competes
  • Redundancy and layoffs

Time limits are short

Employment claims have some of the shortest deadlines in law. In the USA, most federal discrimination claims must be filed with the EEOC within 180 days, extended to 300 days in many states with their own agency. In England and Wales, most employment tribunal claims must start within three months less one day of the dismissal or act complained of, and you must first contact Acas for early conciliation.

Speak to a lawyer as soon as possible, and use our legal deadline calculator to check the dates.

Before you sign a severance agreement

A severance or settlement agreement usually asks you to give up your right to sue in exchange for a payment. Do not sign it in a hurry. A lawyer can check whether the amount is fair and whether you are giving up claims worth more. In the UK, a settlement agreement is only binding if you have received independent legal advice, and employers often contribute towards the cost of that advice.

How employment lawyers charge

Employee claims are often taken on a contingency or no win, no fee basis, especially for discrimination and wrongful termination. Advice on contracts and settlement agreements is usually a fixed fee. Some home or legal expenses insurance policies cover employment disputes, so check yours. Employers are usually charged hourly or on a retainer.

Common questions

Can I be fired for no reason?

In most US states, employment is "at will", so an employer can end it for almost any reason, but not an illegal one, such as discrimination or retaliation. In the UK, employees with two years' service are protected from unfair dismissal, and some reasons are automatically unfair from day one.

How much does an employment lawyer cost?

Many take employee claims on contingency or no win, no fee. Reviewing a severance or settlement agreement is often a fixed fee. Ask how they charge at the first consultation.

Do I have a case against my employer?

It depends on what happened, the evidence and the time limits. A short consultation with an employment lawyer is the quickest way to find out. Bring your documents and a timeline.

Should I sign a severance agreement?

Get it reviewed first. You may be giving up claims worth more than the payment, and there may be room to negotiate better terms.

Can employers use My Legal Hub too?

Yes. Businesses can find employment lawyers for contracts, handbooks, disciplinary processes, redundancies and defending claims.
