Legal requirements for this document ▾
  • You must be 18 or over to make a Will (exceptions exist in some jurisdictions for married minors or military personnel).
  • The Will must be in writing - a verbal Will is not legally valid in most countries.
  • You must sign the Will at the end in the presence of exactly 2 witnesses, both present at the same time.
  • Both witnesses must then sign the Will in your presence - all three of you must be in the same room throughout.
  • Witnesses (and their spouses or civil partners) must not be named beneficiaries in the Will. If they are, the gift to them fails but the rest of the Will remains valid.
  • A solicitor is NOT required to sign or witness a Will - any two independent adults of sound mind can witness.
  • Making a new Will automatically revokes any previous Wills - include a revocation clause to be clear.
  • In England & Wales, getting married or entering a civil partnership revokes a previous Will unless it was made "in contemplation of that marriage".
  • Divorce does not revoke a Will in England & Wales, but your ex-spouse is treated as if they had died on the date of divorce.
  • Keep the signed original - a photocopy is NOT accepted for probate. Never throw the original away.
  • Tell your executor exactly where the original is stored. Consider registering it with a Will storage service (e.g. Certainty in the UK).
  • Amendments (codicils) must be witnessed with the same formality as the original Will.
